The FSVP regulation applies directly to US based importers, brokers and final consignees. The importers, brokers and final consignees of food must establish and follow FSVP regulation in 21 CFR part 1, subpart L. to ensure that each food they import into the United States meets applicable U.S. requirements and is not adulterated or misbranded with respect to allergen labeling. The FSVP Plan can be accomplished within 6-10 business days once BRAVO has received all the necessary food safety documents linked to FSMA regulation from the FSVP importer or from its foreign supplier. In detail BRAVO will put in place the following listed mandatory activities from 1 to 10 and make sure the FSVP importer is in compliance with FSMA regulation.

For Foreign Companies

The FSVP regulation applies directly to the U.S. based importers which includes those who own or are the consignee of food at the time of entry, or, if no owner or consignee exists, to the U.S. FSVP agent as representative of the foreign owner. The FSVP agent must establish and follow FSVP regulation in 21 CFR part 1, subpart L. to ensure that each food imported into the United States meets applicable U.S. requirements and is not adulterated or misbranded with respect to allergen labeling. BRAVO can be the U.S. FSVP agent representative of your foreign company and for each food exported by your company into the USA can develop, maintain, and follow with its Preventive Control Qualified Individual experts a Foreign Supplier Verification Program (FSVP) Plan (as required under the Foreign Supplier Verification Program regulation in 21 CFR part 1, subpart L). For Food Held by FDA

The FSVP regulation applies directly to the U.S. based importers which includes those who own or are the consignee of food at the time of entry, or, if no owner or consignee exists, to the U.S. FSVP agent as representative of the foreign owner. The FSVP agent must establish and follow FSVP regulation in 21 CFR part 1, subpart L. to ensure that each food imported into the United States meets applicable U.S. requirements and is not adulterated or misbranded with respect to allergen labeling. BRAVO can be the U.S. FSVP agent representative of your foreign company and for each food held at the U.S. port or/and U.S. airport of Entry by FDA can develop, maintain, and follow with its Preventive Control Qualified Individual experts a Foreign Supplier Verification Program (FSVP) Plan (as required under the Foreign Supplier Verification Program regulation in 21 CFR part 1, subpart L). The FSVP Plan can be accomplished within 1-2 business days once BRAVO has received all the necessary food safety documents linked to FSMA regulation from the foreign company or from its suppliers. In detail BRAVO will put in place the following listed mandatory activities from 1 to 10 and make sure the foreign company is in compliance with FSVP regulation.

For Domestic Facilities

The FSVP regulation applies directly to domestic facilities if the facility imports food and re-sells it without any processing or manufacturing. While if a US processing facility imports ingredients and materials used in their own processes and are fully compliant with the Preventive Control rule for Human Food, they are deemed compliant with the FSVP regulation for those ingredients. The domestic facilities must establish and follow FSVP regulation in 21 CFR part 1, subpart L. to ensure that each food they import into the United States meets applicable U.S. requirements and is not adulterated or misbranded with respect to allergen labeling. BRAVO can be the U.S. FSVP agent representative of your domestic facility and for each food imported by your company into the USA can develop, maintain, and follow with its Preventive Control Qualified Individual experts a Foreign Supplier Verification Program (FSVP) Plan (as required under the Foreign Supplier Verification Program regulation in 21 CFR part 1, subpart L). The FSVP Plan can be accomplished within 6-10 business days once BRAVO has received all the necessary food safety documents linked to FSMA regulation from the domestic facility or from its foreign supplier. In detail BRAVO will put in place the following listed mandatory activities from 1 to 10 and make sure the domestic facility is in compliance with FSVP regulation.

  1. Using our certified FSVP Agent and Preventive Control Qualified Individual (PCQI) experts to conduct all the FSVP’s activities;
  2. Written Hazard Analysis on each imported finished product;
  3. Review and assessment of the hazard analysis performed by the foreign supplier;
  4. Evaluation of risk posed by the food and performance of the foreign supplier;
  5. Appropriate corrective actions if it becomes necessary;
  6. Approval of foreign supplier;
  7. Procedures for importing food only from approved foreign suppliers;
  8. Procedures for ensuring appropriate verification activity conducted on the foreign supplier;
  9. Determination of verification of activities conducted on the foreign supplier;
  10. Keep FSVP records for two years available to an authorized FDA representative.
